Legal Update: Nonprofits Await Court Decision on Nonprofit Nonpartisanship

A federal court in Texas is expected to rule soon on a case that could impact the longstanding Johnson Amendment, a 70-year-old law that prohibits nonprofits, including religious organizations, from engaging in partisan political activity.
The pending decision involves a proposed settlement between the IRS, the National Religious Broadcasters, and two Texas churches. Multiple organizations have submitted amicus briefs in recent weeks to weigh in on the case.
